Who we are

kryptonfund.com is operated by Krypton Fund Inc. ("Krypton"), a corporation registered in Delaware, United States, with its mailing address at 1207 Delaware Ave #5027, Wilmington, DE 19806, United States, referred to here as "we" or "us". We are the controller of the personal data described in this policy.

This policy covers this website and the waitlist only. Krypton's products are not yet available; when they are, they will come with their own privacy notices.

What we collect

When you join the waitlist we collect:

• Your name and email address (required).
• Optionally: the products and currencies you are interested in, your monthly volume band, and the type of organisation you represent.
• Whether you agreed to receive product-update emails, and when you submitted the form.
• If you email us, your email address and whatever you choose to include in the message.
• Technical data our hosting provider processes to deliver the site and keep it secure: IP address, browser and device type, the pages requested and the time of the request, held in server logs.

What we do not collect

We do not use analytics, advertising, session-recording or tracking tools, and we do not set tracking cookies. We do not collect payment details, government identifiers or other sensitive personal data through this website, and we ask that you do not include financial account details in the waitlist form.

How we use it, and on what basis

We use personal data only for the purposes below. Where the EU or UK GDPR applies, the legal basis is given in brackets. Where India's Digital Personal Data Protection Act 2023 applies, we rely on the consent you give when you submit the form, or on a legitimate use it permits.

• To confirm your sign-up by email, manage your waitlist place, contact you about early access, and match you to the right product (steps taken at your request before any contract, and our legitimate interest in running the waitlist).
• To send you product updates and early-access news, only if you ticked the box to receive them (consent). You can withdraw consent at any time using the unsubscribe link in any email or by emailing us.
• To keep the website secure and working (legitimate interests).
• To comply with the law and to establish, exercise or defend legal claims (legal obligation and legitimate interests).

No sale, no profiling

We do not sell personal data, share it for cross-context behavioural advertising, or use it for automated decision-making that has legal or similarly significant effects on you.

Who we share it with

We share personal data only with:

• Service providers who process it on our instructions: our website host (Railway) and our email provider (Zoho), which receives waitlist sign-ups and sends your confirmation email. They may not use it for their own purposes.
• Professional advisers, such as lawyers and accountants, under a duty of confidentiality.
• Authorities, where the law requires it.
• A buyer or successor, if Krypton is involved in a merger, acquisition or sale of assets, under the protections of this policy.

International transfers

Krypton is a US company and our service providers may process data in the United States and other countries. Where the EU or UK GDPR applies, we rely on an adequacy decision or on the European Commission's Standard Contractual Clauses (with the UK Addendum where relevant) for these transfers. Where the laws of India or the UAE apply, we transfer data only as those laws permit.

How long we keep it

• Waitlist details: 24 months from the date you join, then deleted — sooner if you ask us, and if you become a customer, the product's own privacy notice takes over.
• Your marketing-email consent record: for as long as we send you emails, and afterwards for as long as we need to show that consent was given.
• Emails you send us: as long as needed to deal with your message, and no longer than 24 months.
• Server logs: kept by our hosting provider for a limited period for security and operations.

Your rights

Depending on where you live, you may have the right to access the personal data we hold about you, correct it, delete it, restrict or object to how we use it, receive a copy in a portable format, and withdraw consent at any time without affecting what happened before. To use any of these rights, email hello@kryptonfund.com with the subject "Privacy request". We may ask you to confirm your identity, and we will respond within one month.

• EU and UK: you can complain to your local data protection authority (in the UK, the Information Commissioner's Office).
• India: you can raise a grievance with us at hello@kryptonfund.com; if it is not resolved, you may complain to the Data Protection Board of India. You may also nominate another person to exercise your rights.
• UAE: you can complain to the UAE Data Office, or to the DIFC or ADGM data protection authority where their law applies.
• California and other US states: you can ask what we collect, and ask us to delete or correct it. We will not treat you differently for doing so. We do not sell or share personal information.

Security

The website is served over encrypted HTTPS and access to waitlist data is limited to the people who need it. No method of transmission or storage is completely secure, but we take reasonable steps to protect your data and will notify you and the authorities of a breach where the law requires.

Children

This website is not directed at anyone under 18, and we do not knowingly collect their personal data. If you believe a child has given us their details, email us and we will delete them.

Third-party embeds and links

The demo video is hosted by YouTube in its privacy-enhanced mode, and nothing is loaded from YouTube until you press play. Once you do, Google may collect data under its own privacy policy. Links to other sites, such as LinkedIn, Calendly or YouTube, are governed by those sites' policies.

Changes to this policy

If we change this policy we will update the date at the top of this page. If a change is material and we hold your email address, we will tell you by email where the law requires it.
